Company Terms of Use Amendments
The following clauses are proposed additions or replacements for the company’s existing Terms of Use at downtothefeltonline.com/terms-of-use/. They should be integrated into a dated, approved policy before publication.
Company identity and scope
These Terms govern use of the websites operated for Down to the Felt Inc, a New Jersey corporation (the “Company,” “we,” “us,” or “our”), including the Company’s Game Room Retail, Casino & Game Rentals, and Amateur Poker League divisions. References to Down to the Felt or DTTF identify the Company unless otherwise stated.
Separate transaction and league agreements
Retail purchases, equipment services, rentals, and event bookings are subject to their applicable written order, quotation, or service agreement. These website Terms do not create a booking, guarantee availability, or replace the transaction’s agreed payment, cancellation, warranty, or equipment provisions. Amateur Poker League participation is also governed by the Poker League Supplemental Terms and Privacy Notice and the separately accepted Player Name, Image and Likeness Release. A subject-specific agreement controls its subject if it conflicts with these website Terms, except where applicable law requires otherwise.
Intellectual property
Company names, branding, league records, and Company-owned photographs and other content remain the Company’s property, subject to applicable law and third-party rights. Website software, source code, application logic, and related development materials remain the property of their respective developer or other rights holder. Access to the website does not transfer ownership of software, Company content, or any participant’s identity. Third-party content remains subject to the rights and license of its owner. Company rights in a photograph do not eliminate the need for applicable likeness permissions.
Privacy and separate permission
The Company Privacy Policy and applicable league privacy notice explain information handling. Acknowledgment of a privacy notice is not a substitute for a separately required media release or other specific consent. Media use is governed by the accepted release, including its withdrawal provisions.
Governing law and preserved rights
These Terms are governed by New Jersey law, except to the extent applicable law requires otherwise. Nothing in these Terms excludes nonwaivable consumer, privacy, publicity, or other legal rights. Any website disclaimer or limitation of liability applies only to the extent permitted by law and does not exclude liability for fraud, willful misconduct, gross negligence, or other liability that cannot lawfully be excluded.
Policy changes and contact
We will identify the effective date of an approved revision and provide notice of material changes through an appropriate website or account notice. Where affirmative agreement is required, we will obtain it before applying the revised agreement to that user. Questions may be sent to info@downtothefeltonline.com or Down to the Felt Inc, 80 Broad St. Suite #2M, Red Bank, NJ 07701.
Poker League Supplemental Terms and Privacy Notice
These supplemental terms and privacy disclosures apply to the Amateur Poker League operated by Down to the Felt Inc. Please read them together with the Company Terms of Use, Company Privacy Policy, current event rules, and separate Player Name, Image and Likeness Release.
1 Eligibility and venue requirements
You must be at least 18 years old to participate. A venue may impose a higher minimum age, including 21 years, or other lawful admission requirements. You must satisfy the requirements for the particular venue and event and provide acceptable age verification if requested. League eligibility does not guarantee admission to a venue or authorize alcohol purchase or consumption. You must comply with applicable law and venue rules.
2 Free league participation
The league’s regular tournaments are free to enter. Tournament chips and league points have no cash value and cannot be exchanged for money or used for side betting. Monetary wagering between players is prohibited at league events. Any prizes, qualification opportunities, or promotional benefits are subject to the published rules for the relevant event or season. No particular prize, result, or qualification is guaranteed.
3 Accounts and player identity
Provide accurate information, maintain one account for your player identity, and protect your login credentials. Do not impersonate another person, claim another player’s record, or share access in a way that permits unauthorized action. Notify the Company of suspected account misuse or a mistaken link between an account and player history. The Company may require verification to establish or correct that link.
4 Registration and check in
Online registration and player check-in are available only when enabled for the event and within the applicable window. They are not available for completed or canceled tournaments. Registration does not itself establish physical presence, guarantee a seat, or override venue admission requirements. Follow the event’s arrival and check-in instructions. Authorized tournament staff may handle registration or check-in under the league’s staff procedures. Players must not submit false location information or register or check in for someone else without authorization.
5 Rules standings and corrections
The published tournament and season rules govern play, scoring, attendance benefits, qualification, and prizes. Tournament directors administer play and address disputes. Results supplied by tournament staff may include a player’s name, finish position, entry time, and elimination time; the system may calculate points and statistics from those records. The Company may investigate mistakes and correct results or standings. Report an apparent error promptly through the Company contact. Substantive rule changes should be communicated before they apply; acceptance of these terms does not itself change a season’s scoring rules.
6 Player conduct
Treat players, staff, and venue personnel respectfully. Cheating, collusion, threats, harassment, discriminatory abuse, violence, disruptive intoxication, unauthorized wagering, and deliberate interference with event administration are prohibited. The Company or venue may remove a player from an event or suspend participation for misconduct, safety concerns, or failure to meet event requirements. The Company may review an incident and impose reasonable participation restrictions consistent with applicable law. Nothing here restricts a person from reporting unlawful conduct or exercising protected rights.
7 Required separate media release
Participation requires affirmative acceptance of the separate Player Name, Image and Likeness Release. That release authorizes Company promotion across Game Room Retail, Casino & Game Rentals, and Amateur Poker League, not only poker promotion. If you withdraw that permission, the Company will stop new promotional uses as described in the release. Under the Company’s participation policy, you must give fresh affirmative consent before participating in another league event, subject to any contrary requirement of applicable law. Website access, privacy-notice acknowledgment, or mere attendance does not substitute for that affirmative consent.
8 Event changes and personal responsibility
Events may be rescheduled, moved, canceled, or subject to capacity limits. Confirm current event details before traveling. You are responsible for your travel, purchases, personal belongings, and conduct. Venue goods and services are supplied by the venue unless expressly stated otherwise. The Company does not promise continuous website availability or error-free results. These provisions do not waive liability or rights that cannot lawfully be waived.
9 Information collected and sources
We receive information directly from you, from authorized tournament staff, and from use of the league website. It may include your name and alias, email, account credentials in their protected form, profile information and images you provide, player-record links, registrations, check-ins, event and venue details, results, entry and elimination times, derived points and statistics, support correspondence, and agreement records. Technical records may include IP address, browser or device information, session information, security events, and login attempts, including attempts involving an unrecognized email. Invalid passwords are not retained as login-attempt records.
10 Purpose and public display
We use this information to verify accounts, manage participation, run tournaments, calculate and publish standings and historical results, administer qualifications and prizes, respond to corrections, protect the website, and document acceptance or withdrawal. Public league records may identify your player name or alias, event participation and results, points, statistics, achievements, and authorized images. Email addresses, account credentials, and device coordinates are not part of public standings or player pages. Public records may remain available after an account is closed, subject to applicable rights and review of a specific request.
11 Location for check in
When device-location check-in is offered, the website may ask you to permit collection of your location to verify proximity to the venue. This is a check-in function rather than continuous background tracking. Denying device permission may prevent automated check-in; contact tournament staff for assistance. Location information is not displayed to other players. Whether exact coordinates or only a verification result are retained must be disclosed in the final notice after the Company confirms the implementation and retention practice.
12 Access sharing and security
Authorized league staff and service providers may access information needed for administration, hosting, media delivery, email, security, development, or support. We may disclose information where required by law or reasonably necessary to address fraud, security incidents, or legal claims. Public league content is accessible to anyone. Private information is subject to reasonable safeguards, but no system can guarantee absolute security. Links to social networks and other services are governed by those services’ policies; following a link does not give the league access to all activity on your social account.
13 Cookies communications and retention
The league website uses session or similar technologies needed for login, security, and website operation. Additional analytics or advertising technologies, if used, must be disclosed in the approved Company Privacy Policy. Account verification, security, and event-administration messages are distinct from optional promotional messages. Accepting the media release does not enroll you in promotional email or text messages. We retain league records, account data, and acceptance records for legitimate operational, historical, security, and legal purposes as reasonably needed, subject to applicable rights.
14 Your requests and agreement records
Send access, correction, deletion, privacy, or media-withdrawal requests to info@downtothefeltonline.com or the Company mailing address. Identify your player name and account email, but do not send a password. We may verify identity. We will assess requests under applicable law and explain any applicable limits. We keep the document version, acceptance date and time, player or account identity, and available evidence of assent or withdrawal. Material changes requiring agreement must be presented for fresh acceptance; a revised page alone does not supply that acceptance.
15 Applicable law and contact
New Jersey law governs these supplemental terms except where applicable law requires otherwise. Nothing in them waives nonwaivable rights or overrides legal protections in the state where an event occurs. Contact Down to the Felt Inc, 80 Broad St. Suite #2M, Red Bank, NJ 07701; info@downtothefeltonline.com.
